Terms and Conditions

Welcome to Tiwariji App, a mobile platform operated by Sharvaya Technologies. These Terms and Conditions (“Terms”) govern your access to and use of the Tiwariji mobile application and related services (collectively, the “Platform”). By downloading, installing, or using the Platform, you agree to be bound by these Terms. Please read them carefully before using our services

1. Eligibility

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you have the legal capacity to enter into a binding agreement under applicable law.

2. Account Registration

To place orders, you may be required to create an account. You agree to:

Provide accurate, current, and complete information;
Maintain the confidentiality of your login credentials;
Immediately notify us of any unauthorized use of your account.

We reserve the right to suspend or terminate any account that provides false information or violates these Terms.

3. Service Overview

Tiwariji App connects customers with restaurants, food vendors, and delivery partners (“Service Providers”). We act only as a facilitator between users and these Service Providers. All food preparation, quality, and delivery timelines are the responsibility of the respective restaurant or delivery partner.

4. Orders and Payments

You may place orders through the Platform using available payment methods (credit/debit card, UPI, wallets, etc.).
Prices, taxes, and delivery charges are shown at checkout.
Payments must be made in full before order confirmation.
Once confirmed, orders cannot usually be modified. Cancellations or refunds depend on the restaurant’s and our refund policy (see Section 6).

5. Delivery

Estimated delivery times are only approximations and may vary due to traffic, weather, or operational delays. The company or its partners are not liable for any delays beyond reasonable control.

6. Cancellation and Refund Policy

Customer-Initiated Cancellations: Orders can be canceled before restaurant acceptance. After acceptance, cancellation may result in a partial or no refund.
Restaurant/Partner Cancellations: If a restaurant is unable to fulfill your order, you will receive a full refund.
Refunds will be processed to the original payment method within a reasonable time frame.

7. User Conduct

Use the Platform for unlawful purposes or in violation of these Terms;
Post or transmit any defamatory, obscene, or infringing content;
Attempt to gain unauthorized access to any portion of the Platform;
Misuse promotions or abuse system vulnerabilities.

Violation of these conditions may result in account suspension or legal action.

8. Intellectual Property

All content, including text, graphics, logos, images, and software on the Platform, is owned or licensed by Sharvaya Technologies. Users are granted a limited, non-transferable, and revocable license to use the Platform solely for personal purposes.

9. Third-Party Services

The Platform may include links or integrations with third-party services (e.g., payment gateways, restaurant APIs). We are not responsible for the privacy, accuracy, or practices of such third parties.

10. Privacy

Your personal data is collected, stored, and processed in accordance with our Privacy Policy, which complies with Google Play’s Data Safety and transparency requirements. Please review it carefully before using the Platform.

11. Limitation of Liability

Sharvaya Technologies shall not be liable for any indirect, incidental, or consequential damages.
Our total liability for any claim shall not exceed the amount paid by you for the transaction in question.

12. Indemnification

You agree to indemnify and hold harmless Sharvaya Technologies, its affiliates, and employees from any claims, losses, or damages arising from your use of the Platform or violation of these Terms.

13. Termination

We may suspend or terminate access to your account at any time for violation of these Terms or misuse of the Platform. Upon termination, your right to use the Platform will immediately cease.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, and disputes shall be subject to the exclusive jurisdiction of the courts in [City, State].

15. Updates to These Terms

We may update or modify these Terms from time to time. Continued use of the Platform after any such update constitutes your acceptance of the revised Terms.
